Benjamin Borden

BIOGRAPHY: TOWN BOOK OF OLD MIDDLETOWN, N.J.; ; Sanford, N.C., Microfilming Corp of America, 1983, originally pub 18--; Pg 32-33; Family History Library Fiche 6046401; NOTES: Probably removed soon after purchasing land in Shrewsbury in 1665, from Portsmouth to settle in Middletown, being allotted Lot 29 on 30 Dec 1667, and the next day Lott No. 23 in "the Lotts that are in the Poplar Field and the Mauntany Field". (Ref: Town book of Old Middletown, 1). He moved finally in 1713 to Evesham, Burlington Co. Justice of Peace in Shrewsbury, 1685. In 1692 & 1694 was elected to the assembly from Middletown, and in 1695 & 1698 as one of the six members from Monmouth County. He was road commissioner, 1693-1711 for Monmouth, E. Jersey. He was one of the three men "legally chosen on 1 Jan 1695/6 to meet the men of other town of the County to assess ...the tax rate that is to be raised for support of the government," to which office (corresponding with the chosen Freeholders of today) he was reelected in 1697-8. (Ref: Town Book 32-33). He was agent for the receipt of Monmouth County taxes, 1705-1706.

LAND-HISTORY: Old Times in Old Monmouth; N.J. Arch. pp 170-71, 207, 280, 249. N.J. Arch. Vol 21 EXTRACTS: On February 8, 1677, he was patented 300 acres and another 290 acres on the Chohanzic River. On June 30, 1677 shows he was granted a patent for 351 acres; 150 acres in Monmouth Co. on January 22, 1687. Benjamin Borden, of the town of Monmouth, East Jersey, assigned land to William Hudson on July 19, 1687. On March 28, 1688 deeded by John Throckmorton 1/20 of 1/48 share in 616 acres with improvement. In 1699, he was deeded 474 acres at Crosswicks by John Throckmorton, also 10 acres of meadow land. On June 15, 1697, he deeded to James Hudson, son and heir of William Hudson, deceased, 300 acres on Chohansey River. In 1716, Benjamin appears to have been in Evesham, Burlington County, N. J., when he conveyed land to his son Joseph. In 1718, being then in Auchweas, Burlington County, he conveyed land to his son James.

Court of Sessions and Pleas November 4th and 5th 1700

A Bill or Indictment being delivered to the Grand jury from the Kings Attorney against Benjamin Burden, the Grand jury came into Court, and deliver said Bill, with these words written thereon, We the Grand jury do find this a truebill -- John Shin foreman.

The court adjourn'd till Afternoon, and then again Opened.
Benjamin Burden sett to the Barr -- The Bill or Indictment read in these words (vizt) We the Jurors for our Sovereign Lord the King, and for the body of this County, do present That whereas Benjamin Borden of Freehold in the Province of East Jersey, The Eleventh or twelfth day of October 1700 at this Town of Burlington, of Set purpose and deliberately and with malicious intent, did Sett forth amoungst other things, this false Seditious and Scandalous matter to defamation of our Governor Coll Andrew Hamilton (that he the said Governour was run away) with an evil intent to disturb the Peace of this Province, and contrary to divers Statutes made and provided and to the evil Example of all others in the like cause offending etc.
To which Indictment the Prisoner pleaded Not Guilty -- The Court demanding of him, Whether he would referr himself to the Bench or put himself upon his Tryall by Jury -- The Prisoner answered he would put himself upon Tryal by the Country.

The Petty Jury Attested were -- Matthew Watson, John Lambert, John Cheshire, Thomas Ridgway, John Shin junr, John Hilliard, George Elkington, Samuel Lippincutt, John Powel, Thomas Bishop, Thomas Smith, Matthew Foresith.

[a Paper Evidence] The Deposition of George Willis George Willis being Solemnly Attested saith That Benjamin Borden comeing into his house the last night or Evening, And some Enquiry being made of what News from East Jersey (he comeing from thence) the said Benjamin Burden replyed and reported, That the Governour was ran away, and further saith not, Attested the 12th day of October 1700 before me -- Samuel Furnis Burgess.

[Evidence] George Willis in open Court being Attested saith, that Benjamin Burden comeing into his house (Said Burden comeing then from East Jersey), was asked what news from thence, he answered that the disturbances there were not yet quieted And furthe the said Burden said -- Suppose the Governour is run away, and further saith not.

[The Prisoners Plea] The Court demanding of the Prisoner what he had to say from himself The Prisoner denyes that ever he spoke any such like words. The Court adjourn'd to Henry Grubbs -- and there opened the Court of Pleas. The Court of Sessions adjourn'd to to morrow morning 8 a Clock.
November 5th, the Court of Sessions opened.

[The verdict] The Jury bring in their Verdict in these words (vizt) We the Jury are all agreed that the Prisoner (according to the Evidence) is guilty of saying (Suppose the Governour is run away). The Court asking the Prisoner whether he had anything to offer in Arrest of Judgment or otherwise and haveing nothing material to move to the Court

[Judgment] Judgment of the Court is, The he (the Prisoner) be and is fined One hundred pounds and Costs of Suit, remanding into the Sheriffs Custody till paid etc.

[Note: a few days later Nicholas Brown was brought into court by the Sheriff under suspicion for helping Benjamin Borden escape from the sheriff on Brown's horse.]

Note on the above: West Jersey was largely settled by Quakers, who were not popular among the rest of the population. The Quakers had appointed Andrew Hamilton as Governor of West Jersey. Some question arose as to his eligibility, he being a Scotsman. He was removed from office, and Jeremiah Basse, a strong anti-Quaker, was appointed. He loaded the courts with like-minded men, and the Quakers were harassed. Eventually the West Jersey Society determined that Hamilton was indeed eligible to serve as Governor, and was reinstated. Benjamin Borden was violently anti-Hamilton, and no doubt did make the alleged statements against him.

Joane Fowle

In her father's will, he wills his little house to his grandchild Richard Borthen and to Joane Borthen, his daughter, an annuity of 40 shillings a year out of my lands in Frittenden.

BIOGRAPHY: letter from Carol Elaine Warren Jackson to "Mr. Yeiser"; 12/20/81; copy in possn of T.Mason (filed - Philip Yeiser); EXTRACTION: (Contains two pages of family records.) Family Bible owned by Dr. Richard Jackson, apparently belonging to Affie Yeiser Jackson, daughter of Daniel Yeiser is the following (List birth dates and names of Chrisman, Affie and 8 children; plus (not from Bible) children and spouses of John D. Jackson.) "John is the "Old Dr. John" dear to so many here in Danville. Before married a woman named Julia Gentry when he was rather young, knowing at the time that she had tuberculosis. Apparently after a short time, her condition forced her to go to a sanitarium in North Carolina, where she died not long afterward".

John was a much loved doctor and surgeon in Danville, Ky. After his first wife died, he married his cousin Kate Strouse.

He lived in El Centro, California for short time with wife, Katherine after they were first married. Then they returned to Danville where their children were born.

RESEARCHER: wrote the following to T.Mason on 23 Aug 2003, "An incident in the life of Dan that was unique to me, at the time, now I understand it isn't unusual. I was 10 when Dan died, at home, following a serious bout of strep. He had a small flock of sheep. He fed them at the same time religiously. Betty was 18 or 19 at the time and she kept the sheep fed during Dan's illness but they did not eat as well. Dan died about 8:15 in the morning and the sheep started to bleat at almost the same time. They "cried & cried". They were so forlorn Sybil had to call someone to come pick them up and take them away. She could not handle their grief."

REFERENCE: Historical Collections of the Joseph Haversham Chapter of the Daughters of the American Revolution is a letter of Rebecca F. Sasnett Green, the text is quoted in a brown text of Catharine F. (Borden) Mason, as she researched in Los Angeles. In the letter Mrs. Rebecca F. Sasnett Green, says, "little is known of Joseph except that after his father death, (Benjamin Sr. called Fairfax Ben) he, Joseph emigrated from Va. to North Carolina and he married a widow Furgeson, who was Jane Warren & several years after, Joseph began suits over the property that had been illegally sold by his brother Benjamin's executors." Catharine explains, "We children received a small portion of the settlement as did the Sasnetts."

Jane Warren

She & her step sister (who was the grandmother of Governor William Raburn) are said to be nieces of Gen. Joseph Warren, hero of Bunker Hill. Mrs Raburn was an ancestor of Mrs. Governor Northern.
