WILL: 1870. Francis T. D. Taylor's. Last will and Testament

I, Francis T.D. Taylor of Baltimore City in the State of Maryland being of sound and disposing mind and memory do make and publish this my last Will and Testament, hereby revoking all other wills by me heretofore made and declaring this and none other to be my Last Will and Testament. After the payment of my just and lawful debts and Funeral Expenses, I direct property to be disposed of as follows.

Item.  I give and bequeath to The Protestant Episcopal Theological Seminary of Virginia located near Alexandria in the State of Virginia, the sum of One thousand dollars.

Item.  I give and bequeath to Washington College at Lexington in the State of Virginia, being the institution over which Gen. Robert E. Lee now presides, the sum of One thousand dollars.

Item.  I give and bequeath to the Southern University in Tennessee, or if there be no Institution bearing that name to the "Sewanee Collegiate Institute" at Winchester in Tennessee the sum of One thousand dollars.

Item.  I give and bequeath to the China Mission, being the mission over which the Rt. Rev. Channing Moore Williams  D. D. Missionary Bishop exercises jurisdiction and of Which Rev. E. H. Thompson is reported to be the Standing Committee, the sum of One thousand dollars and I direct my Executor to pay over said sum to whomsoever may be the recognized Standing Committee of Said Mission at the time of my death.

Item.  I give and bequeath to the Western Africa Mission, being the Mission over which the Rt. Rev. John Payne D. D. Missionary Bishop exercises jurisdiction, the sum of One thousand dollars.

Item.  I give and bequeath to the Bishop Seabury Mission at Faribault Minnesota, presided over by the Rt. Rev. Henry Benjamin Whipple D.D. Bishop of Minnesota, the sum of One thousand dollars.

Item.  I give and bequeath to the Baltimore Female Orphan Asylum located, on Stricker Street in Baltimore City, the sum of Five hundred dollars.

Item.  I give and bequeath to The Church Home and Infirmary of Baltimore the sum of Five hundred dollars.

Item.  I give and bequeath to the Union Protestant Infirmary in Baltimore City the sum of Five hundred dollars.

Item.  I give and devise to Sherwood Church at Cockeysville one acre of land adjacent to the graveyard to be used as a graveyard. Said acre to be laid off by my executors and I direct, as a condition upon which said land is to be held, that the vestry of Sherwood Church shall keep said graveyard enclosed by a proper fence and shall keep the lot in said graveyard in which I expect to be buried enclosed by an iron railing and shall keep said lot and fence in good condition and repair.

Item.  I give and bequeath and devise to my grand niece Maria N. Bascom, her heirs and assigns in fee simple the lot and improvements No 265 St. Paul Street, where I now reside - And I direct my executors to pay the balance of purchase money for said property - when the same shall become due and to extinguish and redeem the ground rent payable thereon so that said Maria shall hold said dwelling house and lot in fee simple, Free and discharged of all liens, claim or encumbrances.

Item.  I give and bequeath to my niece Fanny Turnbull, wife of Alexander Turnbull, the sum of Ten thousand dollars to be enjoyed by her, to her sole and separate use during the term of her natural life and at her death to be divided among the children of said Fanny Turnbull and in the case of the death of any of the children of said Fanny during the lifetime of said Fanny leaving issue living at the time of the death of said Fanny such issue shall take and receive the portion which its or their ancestor would if living have received.
Item.  I give and bequeath to my grand niece Colgate M. Rudd, daughter of Charcilla Moore (formerly Van Pradelles), the sum of Five thousand dollars.

Item.  I give and bequeath to Chessie C. Moore, another daughter of Charcilla Moore aforesaid, the sum of Five thousand dollars.

Item.  I give and bequeath to Fanny Moore and Francis Moore , children of Mary Moore (formerly Van Pradelles), the sum of Five hundred dollars each.

Item.  I direct that of the farm now occupied by Samuel and Jared Morgan of use as tenants that a tract of one hundred and twenty acres shall be laid off by my executor including the building occupied by said Samuel and Jared Morgan and I give and devise said tract of one hundred and twenty acres with the improvements to my grand nephew S. Clarke Bascom, his heirs and assigns in fee simple. And I will and direct that said Samuel and Jared Morgan shall continue to occupy said tract on a farm of one hundred and twenty acres as tenants to said S. Clark Bascom, his heirs and assigns upon the same terms and condition upon which they now occupy the same as long as they live or the survivor as long as he lives if they or he shall so elect said Morgan not however to have the power to assign or sublease the same.

Item.  I give and bequeath to Charcilla Mason and to Mary Mason, the daughter of Ann E. Mason, each the sum of One thousand dollars.

Item.  I give and bequeath to June Lee, daughter of Cassandra Lee, the sum of One thousand dollars.

Item.  I give and bequeath to Fanny T. Turnbull, daughter of Alexander Turnbull, the sum of One thousand dollars.

Item.  I give and bequeath to my grand nephew Alpheus W. Bascom and John Colgate Bascom each the sum of One thousand dollars.

Item.  I give and bequeath to Elizabeth Goodwin daughter of Edwin Goodwin the sum of One thousand dollars.

Item.  I give and bequeath to said Elizabeth Goodwin in trust to pay the interest during his life to her brother William Goodwin and at his death I bequeath the same to said Elizabeth Goodwin all the foregoing legacies. I direct my executor to pay in current funds of the United States of America and I authorize and empower my executor to sell at public or private sale my real estate not specifically herein devised and to convey the same to the purchaser or purchasers thereof if they deem such sales judicious or advisable.

Item.   All the rest residue and remainder of my estate and property including all that I shall die seized or possessed of whether real, personal or mixed I give devise and bequeath to my two grand nieces Maria N. Bascom and Fanny T. Turnbull daughter of Alexander Turnbull to be divided between them as tenants in common share and share alike to them their heirs and executors and administrators forever. Lastly, I do nominate constitute and appoint Rev. Peyton C. Harrison, Joshua F. Cockey, and Richard J. Gittings executors of this my Last Will and Testament in witness whereof I have here unto affixed my hand and seal this 2nd day of May A. D. 1870.

On the 27th day of June 1870 came W. Chew Van Bibber, Caroline A. Winder and Caroline W. Wisong three of the subscribing witnesses to the aforegoing last Will and Testament of Francis T. D. Taylor late of said City, deceased, and made  oath  on  the  Holy  Evangely of  Almighty  God, that they did see the Testatrix sign and seal this Will; that they heard her publish, pronounce and declare the same to be her last Will and Testament; that at the time of her doing so she was, to the best of their apprehension, of sound and disposing mind, memory and understanding; and that they together with Richard I.  Gittings, the other Subscribing Witness, thereto subscribed their name as witness to this Will in her presence, at her request, and in the presence of each other.

I, Fanny T. D. Taylor, being of sound and disposing mind do make and publish this codicil to my Last Will and Testament which was executed by me on the Second day of May AD 1870 which Last Will I do confirm and republish in all respects except so far as I may herein declare. I give and bequeath to my grand niece Maria  M. Bascom  all the household and kitchen furniture, including my silver and plated Ware. Contained in my dwelling house No 265 St. Paul Street and also my jewelry.

Item. I give and bequeath to Rev. William Pendelton, for the benefit of the Episcopal Church in Virginia of which he is the Rector, One hundred dollars.

Item.  I give and bequeath to William Woodward, to be applied towards paying for a memorial tablet to be placed in memory of Dr. Henshaw in the new St. Peters Church in Baltimore, the sum of one hundred dollars.

Item.  I will and direct that the watch, the likeness and writing desk which belonging to my husband be repaired and sent to David Taylor, my husband's nephew residing in the South.

Item.  I give and bequeath to John O. Turnbull the United States Government  5/20  Bonds No 63294 for the payment of Five hundred dollars.

Item.  I give and bequeath to Agnes, wife of Nesbitt Turnbull the U. S. Government Bond No 1863 for the payment of one hundred dollars.

Item.  I direct that George Brown, son of Alexander D. Brown and Nesbitt Turnbull son of Alexander Turnbull and Nesbitt Lee son of Thomas J. Lee shall each receive from my Executors a ring to cost one hundred dollars each.

Signed, sealed, published and declared by the above named Testatrix, Fanny T. D. Taylor as and for her Last Will and Testament in the presence of us who in her presence at her request and in the presence of each other have subscribed our names as Witnesses thereto the words "and Nesbitt Lee son of Thomas J. Lee" having been interlined on the third page before the execution of this Will or codicil and also the word "Fifty" erased and One hundred inserted on the record page.

Baltmore City, s s. On the 27th day of June 1870 came Richard I. Gittings and made oath  on  the  Holy  Evangely of  Almighty  God , that  he doth not know of any Will or Codicil of Francis T. D. Taylor late of said City, deceased, other than the above instrument of Writing and that he received the same from the Testarix on the day of their respective dates and has retained possession of them since then. That the Testatrix departed this life on the 23rd day of June 1870

Taylor late of said City, deceased, and made  oath on the  Holy  Evangely of  Almighty  God  that they did see the Testatrix sign and seal this Codicil; that they heard her publish, pronounce and declare the same to be a codicil to her last Will and Testament; that at the time of her doing so she was, to the best of their apprehension , of sound and disposing mind, memory and understanding; and that they together with Mary E. Lansdale, the other subscribing Witness, hereto subscribed their name to this Codicil at her request, and in the presence of each other.

In Baltimore City Orphans Court:
The Court, after having carefully examined the above last Will and Testament of Francis T. D. Taylor, late of Baltimore City, deceased, together with the Codicil thereunto attached, and also the evidence adduced as to its validity, Orders and Decrees, this Twenty Seventh day of June 1870, that the same be admitted in this Court as the true and genuine last Will and Testament and Codicil of the said Francis T. D. Taylor deceased.

The Undersigned Peyton Harrison, appointed one of the Executors in the last Will and Testament of Francis T. D. Taylor, late of Baltimore City, deceased, do hereby refuse to act as Executor of said Will and do therefore renounce my right to LETTERS TESTAMENTARY upon said deceased's Estate, and all right, title and claim, that I may, or could have, by virtue of said appointment.
